This Privacy Policy (“Policy”) explains how ACT WRITE HERE, INC. (“AWH”) collects, uses, discloses, retains, and protects information in connection with the AWH website, platform, applications, services, tools, content, and related features (collectively, the “Platform”). This Policy is incorporated into and should be read together with AWH’s Terms and Conditions of Service (“Terms”). Capitalized terms used but not defined in this Policy have the meanings given to them in the Terms.

For purposes of this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an identified or identifiable individual, and includes “personal information,” “personal data,” and similar terms under applicable privacy laws.

AWH is a creator-first platform intended to support writers, actors, creatives, filmmakers, and entertainment industry professionals. Because the Platform may involve scripts, actor materials, table reads, profiles, collaboration tools, ratings, recommendations, recordings, communications, and other creative materials, this Policy is intended to explain both ordinary account-level data practices and Platform-specific data practices relating to creative materials and user-to-user interactions.

1. Scope.

This Policy applies to information AWH collects through the Platform, through communications with AWH, through support and reporting channels, through payment and account-administration processes, and through related services or integrations that link to or reference this Policy. This Policy does not apply to third-party websites, applications, payment processors, video conferencing services, social login providers, cloud services, analytics providers, or other third-party services that are not controlled by AWH, even if those services are linked to or integrated with the Platform.

2. Information AWH Collects.

AWH may collect the following categories of information, depending on how User uses the Platform:

2.1. Account and Contact Information. Name, email address, username, password or authentication credentials, account settings, contact preferences, account status, subscription status, support history, and similar account-administration information.

2.2. Profile and Professional Information. Writer, actor, creator, filmmaker, or professional profile information, such as biography, credits, experience, skills, roles, genres, interests, union or guild information if provided by User, representation status if provided by User, project interests, preferences, availability, headshots, reels, resumes, voice samples, self-tapes, and other profile materials.

2.3. User Content and Creative Materials. Scripts, screenplays, treatments, outlines, pitch materials, loglines, notes, comments, feedback, table-read materials, recordings, audio, video, messages, files, and other User Content uploaded, submitted, shared, generated, transmitted, or otherwise made available through the Platform.

2.4. Communications and Collaboration Information. Messages, invitations, table-read participation information, comments, notes, feedback, ratings, recommendations, collaboration activity, reports, support requests, abuse reports, dispute information, and other communications submitted through or in connection with the Platform.

2.5. Institutional and Group Account Information. Information relating to institutional, educational, nonprofit, theater, enterprise, or group accounts, including administrator information, seat assignments, authorized users, account access, institution-provided user information, billing status, and account-level usage or administrative records.

2.6. Payment and Transaction Information. Subscription selections, billing history, payment status, transaction identifiers, invoice information, chargeback or dispute information, and limited payment-related details. Payments may be processed by third-party payment processors, and AWH does not need to receive or store full payment-card numbers to process ordinary subscription payments.

2.7. Device, Usage, and Technical Information. IP address, device identifiers, browser type, operating system, referring URLs, pages or features viewed, session data, log files, diagnostic information, approximate location derived from IP address, cookie identifiers, crash data, performance information, and similar technical information.

2.8. Security, Verification, and Compliance Information. Information used to detect fraud, abuse, scraping, unauthorized access, AI misuse, intellectual property misuse, safety issues, violations of the Terms, or other prohibited conduct. Where appropriate, AWH may request identity verification information, including government-issued identification or related information, as a condition of continued access or for legal, safety, trust, or compliance purposes.

2.9. Information From Third Parties. Information from service providers, payment processors, social login providers, institutional administrators, other Users, reporting parties, publicly available sources, security vendors, analytics providers, and other third parties where permitted by law and relevant to operation, safety, compliance, or administration of the Platform.

3. Sensitive Information and Creative Materials.

AWH does not require User to include sensitive personal information in User Content, profile materials, messages, table reads, recordings, or other Platform materials, and User should not upload sensitive personal information unless User has determined that doing so is necessary and appropriate. However, because the Platform is used by writers, actors, creatives, and entertainment professionals, User may choose to provide information that may be sensitive or personal, including images, voice, likeness, union or guild information, demographic information, biographical information, or other information contained in creative materials or professional profiles. AWH processes such information to operate, provide, secure, maintain, improve, and administer the Platform; to facilitate User-directed sharing, collaboration, matching, table reads, communications, and account features; to enforce the Terms; and to comply with legal obligations. AWH does not use sensitive personal information for purposes of inferring characteristics except as reasonably necessary to provide User-directed Platform functionality, comply with law, maintain security, prevent abuse, or as otherwise disclosed to User.

4. How AWH Uses Information.

AWH may use information for the following purposes: (a) to provide, operate, maintain, secure, and improve the Platform; (b) to create, administer, authenticate, and manage accounts; (c) to process subscriptions, payments, invoices, renewals, cancellations, chargebacks, and billing-related communications; (d) to enable User-directed profile, matching, collaboration, messaging, table-read, feedback, rating, recommendation, storage, and sharing features; (e) to communicate with User regarding account, subscription, support, legal, operational, security, and Platform matters; (f) to provide customer support and respond to inquiries, reports, requests, complaints, and disputes; (g) to detect, investigate, prevent, and respond to fraud, abuse, scraping, unauthorized access, AI misuse, intellectual property misuse, security incidents, policy violations, and other harmful or unlawful activity; (h) to enforce the Terms and other applicable policies; (i) to comply with legal obligations, court orders, subpoenas, governmental requests, regulatory requirements, and law-enforcement requests; (j) to protect the rights, safety, property, and interests of AWH, Users, rights holders, and third parties; (k) to conduct analytics, measure usage, improve functionality, develop new features, and evaluate Platform performance; and (l) to support corporate transactions, audits, compliance, recordkeeping, and business administration.

5. User Content, Profiles, and Sharing Features.

User controls what User chooses to upload, submit, disclose, or share through the Platform. User Content, actor materials, writer materials, profile information, messages, feedback, ratings, recordings, and other materials may be visible to other users, collaborators, participants, reviewers, readers, actors, writers, institutional administrators, or other third parties depending on User’s settings, Platform functionality, institutional account rules, and User-directed sharing choices. AWH does not guarantee that content designated as private, shared, collaborative, or confidential will remain free from unauthorized access, copying, screenshots, recordings, downloads, exports, disclosure, misuse, or retention by other users. AWH may retain, preserve, archive, or disclose User Content and related information as reasonably necessary for Platform operations, backup, legal compliance, dispute resolution, enforcement of agreements, security, abuse prevention, or other purposes described in this Policy and the Terms.

6. AI, Automated Tools, and User Content.

Consistent with the Terms, AWH is committed to protecting creators and creative ownership against unauthorized artificial intelligence, machine learning, scraping, synthetic media, and automated exploitation. AWH does not claim ownership over User Content, does not train proprietary generative AI models using User Content, and does not sell, license, or provide User Content for third-party AI training purposes unless AWH expressly discloses otherwise and obtains any required consent. AWH may use automated tools, technical systems, metadata, analytics, moderation tools, security tools, or other technology to operate, secure, maintain, improve, and protect the Platform; detect abuse, fraud, scraping, AI misuse, intellectual property misuse, or prohibited conduct; provide matching, recommendation, ranking, search, safety, moderation, or account features; and enforce the Terms. Such operational uses do not transfer ownership of User Content to AWH and do not authorize AWH to sell User Content for third-party AI training.

7. Cookies, Analytics, and Similar Technologies.

AWH may use cookies, pixels, SDKs, local storage, log files, and similar technologies to operate the Platform, authenticate Users, remember preferences, maintain security, prevent fraud, understand usage, improve performance, measure feature engagement, diagnose errors, and support analytics. User may be able to manage cookies through browser settings, device settings, or Platform settings, but disabling cookies may affect Platform functionality. AWH may use analytics and technical service providers to understand how the Platform is used and to improve Platform performance. AWH does not authorize third-party tracking technologies to use User Content for AI training, scraping, or unauthorized exploitation of creative materials.

8. How AWH Discloses Information.

AWH may disclose information as follows:

8.1. At User Direction. AWH may disclose information and User Content when User uploads, shares, posts, submits, sends, invites, collaborates, participates in table reads, uses matching or recommendation features, communicates with other users, connects with institutional accounts, or otherwise directs AWH to make information available through the Platform.

8.2. To Other Users and Participants. AWH may disclose profile information, User Content, collaboration information, messages, comments, feedback, ratings, recordings, table-read information, and related information to other users, collaborators, reviewers, readers, actors, writers, participants, or other persons as needed to provide User-directed Platform features.

8.3. To Service Providers. AWH may disclose information to vendors, contractors, consultants, hosting providers, cloud storage providers, payment processors, analytics providers, security providers, customer-support providers, communications providers, email providers, technical vendors, and other service providers that process information on AWH’s behalf or assist in providing the Platform.

8.4. To Institutional Account Administrators. If User accesses the Platform through an institutional, educational, nonprofit, theater, enterprise, or group account, AWH may disclose account-level information, access status, seat assignments, usage information, administrative information, and other information reasonably necessary to administer that account to the applicable institution or account administrator.

8.5. For Legal, Safety, and Enforcement Purposes. AWH may disclose information where AWH believes disclosure is reasonably necessary to comply with law, court order, subpoena, legal process, governmental request, regulatory requirement, law-enforcement request, or applicable rule; to enforce the Terms; to investigate or respond to fraud, abuse, scraping, AI misuse, intellectual property misuse, security incidents, or prohibited conduct; or to protect the rights, safety, property, or interests of AWH, Users, rights holders, or third parties.

8.6. In Business Transfers. AWH may disclose, transfer, or make available information in connection with any merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of assets, diligence process, corporate transaction, or similar business transaction involving AWH, subject to reasonable confidentiality or successor obligations where appropriate.

8.7. Aggregated or De-Identified Information. AWH may use and disclose aggregated, anonymized, or de-identified information that does not identify User or disclose the substance of User Content for analytics, research, product development, business, operational, security, reporting, or other lawful purposes.

9. No Sale or Sharing of Personal Information.

AWH does not sell Personal Information and does not share Personal Information for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”). AWH also does not knowingly sell or share Personal Information of individuals under sixteen (16) years of age. If AWH’s practices change, AWH will update this Policy and provide any legally required notice and opt-out mechanism.

10. Payments and Payment Processors.

Payments may be processed by third-party payment processors. AWH may receive information such as payment status, transaction identifiers, subscription status, billing address, last four digits of a payment card, card brand, chargeback information, and related transaction records. AWH does not need to receive or store full payment-card numbers to process ordinary subscriptions. Payment processors process payment information under their own terms, privacy policies, and security practices.

11. Third-Party Services and Integrations.

The Platform may include links to or integrations with third-party websites, applications, platforms, tools, social login providers, payment processors, video conferencing services, cloud storage providers, AI integrations, analytics providers, or other services. Third-party services are not controlled by AWH, and their privacy practices are governed by their own policies. User should review the privacy policies and terms of any third-party services User chooses to use.

12. Data Retention.

AWH retains information for as long as reasonably necessary to provide, operate, maintain, secure, and improve the Platform; maintain User accounts; provide subscriptions; support User-directed sharing, collaboration, table reads, and communications; comply with legal, tax, accounting, and regulatory obligations; resolve disputes; enforce agreements; preserve evidence; prevent fraud, abuse, scraping, AI misuse, and security incidents; and protect the rights, safety, property, and interests of AWH, Users, rights holders, and third parties. Retention periods may vary depending on the type of information, User settings, account status, subscription status, legal requirements, backup cycles, dispute or enforcement needs, and operational requirements. AWH may retain archived, backup, or residual copies of information for a reasonable period, even after account deletion or content removal, where necessary for legal compliance, dispute resolution, security, backup, enforcement, or legitimate business purposes.

13. Security.

AWH uses reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, disclosure, or destruction. No system, website, application, platform, storage system, transmission, or security measure is completely secure, and AWH cannot guarantee that information will remain secure, confidential, uninterrupted, or error-free. User is responsible for maintaining the confidentiality of User’s login credentials and for promptly notifying AWH of any unauthorized access to or use of User’s account.

14. User Choices and Controls.

User may access, update, correct, or delete certain account information through Platform settings where available. User may also adjust certain profile visibility, sharing, communication, and account settings where supported by Platform functionality. User may unsubscribe from certain non-essential marketing communications by using the unsubscribe mechanism provided in the applicable communication, but AWH may still send transactional, legal, security, account, subscription, and operational communications. User may request access, correction, deletion, or other privacy rights by contacting AWH at [email protected]. AWH may need to verify User’s identity and authority before fulfilling a request. Certain requests may be denied or limited where permitted by law, including where retention is necessary to provide the Platform, complete transactions, comply with law, protect security, prevent fraud or abuse, enforce agreements, preserve evidence, resolve disputes, or protect rights and safety.

15. California and U.S. State Privacy Rights.

Depending on User’s jurisdiction and AWH’s legal obligations, User may have rights to request access to Personal Information, obtain a copy of Personal Information, correct inaccurate Personal Information, delete Personal Information, opt out of sale or sharing of Personal Information, opt out of targeted advertising, opt out of certain profiling, limit the use or disclosure of sensitive Personal Information, appeal a denied privacy request, and not receive discriminatory treatment for exercising privacy rights. For California residents, this Policy is intended to provide notice at collection and describes the categories of Personal Information AWH may collect, the purposes for which AWH may use such information, the categories of sources, the categories of recipients, and User’s privacy rights under the CCPA. The categories of Personal Information AWH may collect include identifiers; account and contact information; commercial and transaction information; internet or other electronic network activity information; audio, electronic, visual, or similar information; professional or employment-related information if provided by User; education-related information if provided through an institutional account or by User; inferences and analytics derived from Platform use; and sensitive Personal Information where User provides it or where needed for verification, security, compliance, or User-directed Platform functionality. AWH collects Personal Information from User, User’s device, Platform activity, other users, institutional administrators, service providers, payment processors, social login providers, security vendors, analytics providers, public sources, and other lawful sources. AWH uses and discloses Personal Information for the purposes described in this Policy, including Platform operations, account administration, User-directed sharing and collaboration, payments, security, fraud prevention, legal compliance, analytics, support, enforcement, and business administration. AWH does not sell Personal Information and does not share Personal Information for cross-context behavioral advertising as those terms are defined under the CCPA. AWH does not use or disclose sensitive Personal Information for purposes that require a right to limit under the CCPA, except as permitted by law. AWH will not discriminate against User for exercising legally available privacy rights.

Privacy rights requests may be submitted to [email protected]. User may also designate an authorized agent where permitted by law. AWH may require information reasonably necessary to verify User’s identity, authority, residency, and request before responding. If AWH denies a request and applicable law provides an appeal right, User may appeal by replying to AWH’s decision notice or contacting [email protected] with “Privacy Appeal” in the subject line.

16. International Users.

AWH is based in the United States. If User accesses the Platform from outside the United States, User acknowledges that information may be collected, processed, stored, and transferred in the United States and other jurisdictions where AWH or its service providers operate. Such jurisdictions may have data-protection laws different from those in User’s jurisdiction. Where required by applicable law, AWH will implement appropriate safeguards for international transfers.

17. Children and Minors.

The Platform is not intended for individuals under eighteen (18) years old or the age of majority in User’s jurisdiction, whichever is higher. AWH does not knowingly collect Personal Information from individuals who do not meet the eligibility requirements in the Terms. If AWH becomes aware that it has collected Personal Information from an ineligible minor, AWH may delete such information and terminate the applicable account.

18. Data From Institutional Accounts.

Where User accesses the Platform through an institutional, educational, nonprofit, theater, enterprise, or group account, the applicable institution or administrator may provide information to AWH and may have access to certain account-level information, seat assignments, User access status, subscription status, administrative records, and usage information. User’s access to the Platform through an institutional account may be subject to the institution’s policies and may terminate if the institution modifies, suspends, or terminates User’s access or the applicable account.

19. Do Not Track and Preference Signals.

Some browsers and devices provide “Do Not Track” or similar signals. There is no uniform industry standard for responding to such signals, and AWH may not respond to them unless required by law. Where legally required and technically feasible, AWH will honor legally recognized opt-out preference signals, such as Global Privacy Control, in accordance with applicable law.

20. Changes to This Policy.

AWH may modify, amend, update, or revise this Policy from time to time. For material changes to AWH’s data collection, use, disclosure, or privacy practices, AWH will provide at least thirty (30) days’ advance notice via email, platform notification, or prominent posting on the Platform before such changes become effective, where required by law. Non-material changes become effective upon posting. User’s continued use of the Platform following the effective date of any updated Policy constitutes acknowledgment of the updated Policy.
